PERSONAL INJURY

Personal Injury

aftermath of a car crash

Personal injury litigation begins when one person claims (the plaintiff) to have been injured due to the negligence of another person, business, or governmental entity (the defendant). Family members of someone who died from another’s negligence may file a wrongful death claim against the party they hold responsible for the death. Some of the most common personal injury lawsuits arise from:

  • Vehicular accidents, including cars, trucks, boats, motorcycles, and bicycles.
  • Slip and fall accidents.
  • Dog bites.

There are nuances to personal injury cases. The injured party must prove the defendant was at fault for the accident. The defendant has the opportunity to present evidence that he or she was not at fault, and the plaintiff was at fault, or at least partially at fault for the accident. Under Missouri Law, any award of damages to a plaintiff is reduced by the percentage of fault the plaintiff has for the accident.
